Direct Licensing Policy

1. Purpose

This Direct Licensing Policy sets out the circumstances in which I, Hilary Geddes, may directly license sound recordings and/or music videos that I own or control, including recordings submitted to the Phonographic Performance Company of Australia Limited (PPCA).

I am an independent artist and rights holder. This policy is intended to operate alongside my non-exclusive licensing arrangement with PPCA.

2. Direct licensing

I reserve the right to directly license recordings and/or music videos that I own or control for uses covered by this policy.

I may consider requests for direct licences from broadcasters, venues, digital services, businesses, festivals, producers, filmmakers, advertising agencies, or other music users.

Direct licences may be negotiated on a case-by-case basis, having regard to the proposed use, territory, duration, media, audience, and other relevant circumstances.

Nothing in this policy requires me to offer a direct licence for any particular recording or proposed use.

3. Relationship with PPCA

Where I have authorised PPCA to license particular recordings on my behalf, PPCA will continue to administer those recordings in accordance with the terms of my PPCA Input Agreement and PPCA's applicable licensing arrangements.

This policy does not revoke or limit any licence or authority granted to PPCA under my Input Agreement.

Where a particular use is subject to a licence administered by PPCA, a music user may obtain the relevant licence from PPCA rather than directly from me.

I will consider each request individually and may require additional information about the proposed use before determining whether a licence can be granted.

5. Licensing terms

Where I agree to provide a direct licence, the terms, scope and any applicable fee will be agreed separately with the licensee in writing.

A direct licence may specify, among other things:

• the particular recording(s) covered;

• the permitted use;

• territory;

• duration;

• media or platform;

• exclusivity or non-exclusivity;

• applicable fee or other consideration; and

• any conditions applying to the use.

6. Changes to this policy

I may amend or replace this Direct Licensing Policy from time to time. The current version will be made available on my website or otherwise provided to relevant parties upon request.
